For California residents, a new law has expanded access to fertility care throughout the state.

Formerly known as SB 729, the new law is effective as of January 1st, 2026, and introduces fertility care mandates for many insurance plans offered within California. Depending on your insurance plan, fertility care coverage may differ.
For large group health plans (typically with over 100+ employees), the law mandates coverage for the diagnosis and treatment of infertility as well as associated fertility services.
For small group plans (typically under 100 employees), the law requires plans to offer at least one infertility coverage option as an optional add-on benefit.
Some exceptions to coverage mandates apply. Self-funded Employee Retirement Income Security Act (ERISA) plans, religious organizations, Medi-Cal, Medicare, and California Public Employees’ Retirement System (CalPERS) plans will not be required to offer infertility services coverage until 2027.

In addition to expanding insurance fertility care coverages, the new law also expands the definition of infertility to include same-sex couples and LGBTQ+ individuals.
